      In the name of God Amen I James Elmore of Jessamine County and State of Kentucky, being weak in body but of sound mind and disposing memory for which I thank God, and calling to mind the uncertainty of human life, and being desirous to dispose of all such worldly estate, as it hath pleased God to bless me with, I give and bequeath the same in the manner and form following that that is to say:

      1st It is my will that all my just debts and burying expenses be paid out of the cash on hand. Having heretofore, given to some of my children more property than I have given to the others and wishing to make them all equal in property or money. It is therefore necessary to name the amount which they have each received which is as follows:

      To wit?I have given to my son William Elmore thirteen hundred dollars

      n I have given to my son Edward Elmore thirteen hundred dollars

      n I have given to my son John Elmore thirteen hundred dollars

      n I have given to my son James Elmore thirteen hundred dollars and I have given to my son Thomas D. Elmore thirteen hundred dollars.

      I have also given to my Daughter Rebeca Neal thirteen hundred dollars

      My Daughter Peggy has (also) received thirteen hundred dollars and my Daughter Elizabeth has received thirteen hundred dollars.

      I have heretofore given to my Daughter Sally Featherstone one Negro girl valed at three hundred dollars and she having quick died I now give and bequeath unto her two children James Feathington and Sarah Featherston one thousand dollars to be equaled divided between them, which sum I have left in the hands of my son Thomas D. Elmore, which is to hold in his hands as trustee for said children until they marry or arrive to the age of twenty one years for which sum he is to pay each one of them their portion of the principal at which time it is (also)my will that he shall pay to each one of them their portion of the remainder of my estate, which is not herein specially devised, the interest of which he is hereby directed to pay as above directed in this special devise to them. But should one of them die without issue or before he of she arrive to the age of twenty one years then the other is to received that ones portion and should they both die without issue and before they are twenty one years old, then it is my will that the portion of my estate hereby devised to them shall revert back to and be divided equally among all the rest of my children or their issue.

      I have given to my Daughter Polly Cleaveland one Negro girl valued at three hundred dollars and since her death I have given to her Daughter Mary H. Cleveland two Negro children valued at three hundred dollars and now to make her equal with the other heirs I give and bequeath unto her seven hundred dollars more which sum I have (also) left in the hands of my son Thomas D. Elmore as trustee for said Mary H. Cleveland for which sum he is to pay to her the interest annually at the rate of 6 percent per annum until she marries or until she is twenty one years old and them he is to Pay her the principal, and also her portion of my estate not specially devised and he is to pay her the interest thereon annually as above directed in the special devise. But should she die without issue and before she arrives to the age of twenty one years then her portion of my estate is all to revert back and be equally divided among the rest of my children as their issue.

      It is (also) my will that after my just debts, burying expenses, and special devises are paid?then the remainder of my estate, shall be equally divided among all my children.

      I do hereby ordain and appoint my two sons Edward Elmore and Thomas D. Elmore executors to this my last will and testament hereby revoking all other or former wills by me heretofore made,

      In witness whereof I have hereunto set my hand and affixed my seal this 28th day of August 1848.

      I James Elmore of the County of Jessamine and State of Kentucky do hereby make and publish this codicil to my last will and testament in manner following

      (towit) whereas I have in my will given to my Daughter Peggy Eudaly thirteen hundred dollars which she had previously received and I have this day given to my said Daughter Peggy twelve hundred dollars more which constitutes her portion in full of my estate, and lastly it is my will and desire that this my present codicil be annexed to and made a part of my last will and testament aforesaid in witness whereof I have hereunto set my hand and seal this 13th day of March 1852.
